The High Court issued an immediate order to Amazon and Flipkart to remove all products that violate Reliance and Jio trademarks through a strong dynamic injunction. Justice Saurabh Banerjee issued an interim order that prohibited 21 sellers including Pawan Kumar Gupta from producing or selling or advertising products with Reliance and Jio marks until November 13. The court requires all platforms including Amazon and Flipkart and Meesho and IndiaMART and Snapdeal to reveal the identities of their sellers who conduct unauthorized sales.
The court found that defendants intentionally duplicated Reliance’s distinctive logos and fonts and colors and branding elements to trick customers who depend on brand recognition because they are semi-literate or rural buyers. The court prohibited defendants from using Reliance trademarks or copyrighted designs and from employing domain names or trading names or meta-tags that resemble Reliance branding.
The dynamic injunction from Justice Banerjee provides protection against both present and future infringers who will be identified after the order takes effect. E-commerce platforms need to remove all current and upcoming listings that infringe on trademarks after receiving notification.
The proactive measure protects the long-established ‘Reliance’ and ‘Jio’ brands from the 1960s and 2011 respectively by providing enhanced intellectual property protection against misuse in India’s expanding online market.
